How to Start a Business in Texas: My "Scout’s Guide" for 2025

I’ll be the first to admit it: the idea of starting a business in the Lone Star State can feel a lot like looking at a cockpit full of buttons for the first time. It’s overwhelming, a little scary, and you’re constantly worried about hitting a "red button" you didn't mean to.

I know exactly how that feels because I’ve been in those exact boots. When I launched Live Office Assistant, I had to figure out the paperwork, the filings, and the "Texas way" of doing things all on my own.

Think of me like Lewis and Clark. I’ve already hacked through the brush, found the river crossings, and marked the quicksand. Now, I’m coming back to the start of the trail to grab your hand and show you the way.

Step 1: The "What’s in a Name?" Phase
Before you can hang a sign or even pass out a business card, you need a name. In Texas, you have to make sure no one else is using your "dream name." You’ll check the Secretary of State records, but don’t forget the DBA (Doing Business As) at your local county clerk’s office if you aren't incorporating yet.

Step 2: Picking Your "Vehicle" (Structure)
Are you a Sole Proprietor? An LLC? Think of this like picking the right plane for the job. An LLC is like a sturdy Cessna—it protects you (the pilot) if the "engine" (the business) has a rough landing.

Step 3: The Tax Man (The EIN)
You need a social security number for your business. It’s called an EIN, and it’s free from the IRS. Don’t let anyone charge you to "file" this for you! This is your first "scout tip": it takes ten minutes on a website, and you're done.

Step 4: The Texas Nexus (Sales Tax)
If you are selling "stuff" or certain services in Texas, you need a Sales Tax Permit. Even if you don't think you'll owe much, the State Comptroller wants to know you exist.
